1. scope of application:
The following terms and conditions comprehensively regulate the mutual rights and obligations between the operator of the Schitterhof campsite (hereinafter referred to as "campsite operator") and the campsite guest. The contractual services shall be governed exclusively by the commitments valid for the duration of the stay. Agreements made by telephone, subsidiary agreements and other agreements of any kind whatsoever must be made in writing and confirmed by the campsite operator in order to be valid. Upon registration, the campsite guest accepts these General Terms and Conditions. 2.
With the registration or reservation, the camper offers the binding conclusion of a contract for the provision of a pitch. This can be done in writing (letter/e-mail or website), in exceptional cases also verbally or by telephone. The registration is made by the camper also for all fellow travellers listed in the registration/reservation, for whose contractual obligations the camper is liable as for his own obligations. The camping contract shall only be concluded with the written confirmation of acceptance or by implied acts by the campsite operator or his agents. 3.
3. duration of the reservation period and stay:
The extent of the period for which a camper makes a reservation is in principle binding as soon as the camper starts his stay. It is only possible to shorten the period of stay or the corresponding payment obligation thereafter by mutual agreement. In principle, campers are not entitled to a refund of prepaid camping fees if they break off their stay prematurely. If reserved nights are not used (later arrival or earlier departure), the camper is obliged to pay the respective valid pitch fees for unused nights.
The selection takes place on the day of arrival by mutual agreement. The campsite guest is not authorised to change the pitch without the consent of the campsite operator. The campsite operator reserves the right to allocate a different pitch to the guest even after the reservation has been confirmed.
The prices quoted correspond to the rates available on the website (www.schitterhof.at) at the time the offer was made. Changes and deviations of individual services from the agreed content of the contract, which become necessary after conclusion of the contract and which were not brought about by the campsite operator contrary to good faith, are reserved, insofar as the changes or deviations are not substantial and do not significantly affect the overall contract. In any case, the campsite operator has the right to change the rates of the respective valid price list without influencing the validity of the camping contract, if there are more than 4 calendar months between the conclusion of the camping contract and the start of the stay. The campsite guest, for his part, is allowed to withdraw from the contract according to the provisions of point 6 of these general terms and conditions. All price lists are subject to errors and changes.
6. costs and cancellation of the reservation in the camping contract:
The campsite operator reserves the right to accept reservations only after receipt of a reservation fee (min. 100 euros). The campsite guest may cancel his/her reservation up to eight weeks before the start of the stay. Exceptions to this are bookings for the Formula 1 and MotoGP event weeks at the Red Bull Ring. The campsite operator will then refund any amounts paid, minus the above-mentioned reservation fee. Cancellations made within one week of arrival may be subject to cancellation fees equal to the operators' performance interest.
7. camping regulations:
The current camping regulations form an integral part of these General Terms and Conditions. They are displayed at the campsite or can be downloaded from the campsite website (www.schitterhof.at). If a campsite guest violates the campsite rules, the campsite operator can expel the campsite guest from the campsite. In this case, the camper has no right to a refund of any deposits paid. The campsite operator reserves the right to claim damages in this case.
8. payment of the camping fee:
The entire camping fee for the duration of the registration/reservation period is generally due on the day of arrival. Payment of the fees is always made in cash or by card. On the part of the camping guest there is no claim to any other method of payment.
Any complaints must be reported immediately to the campsite operator by the campsite guest. The assertion of claims for defects is excluded if the campsite operator has not been notified directly during the stay of the campsite guest. The campsite operator shall be given a reasonable period of time to remedy the defect.
The campsite operator shall not be liable for any damage caused by the failure or disruption of the water, electricity and gas supply, or as a result of noise pollution caused by third parties. Furthermore, the campsite operator shall not be liable in the case of slightly negligent breaches of duty for damage caused by the use of the facilities or equipment located on the premises or facilities, equipment and arrangements that have become inoperative or are out of operation. This also applies to slightly negligent breaches of duty by the campsite operator's legal representatives or vicarious agents.
11. Austrian law shall apply. The place of jurisdiction shall be Leoben/Styria.
